These Terms of Service ("Terms") govern your access to and use of the website www.wacoscapes.com (the "Website") and all services provided by Wacoscapes, LLC, a Texas limited liability company ("we," "us," or "our"). By accessing the Website or engaging our services, you agree to be bound by these Terms.

1. Services

We provide residential and commercial landscaping services, including but not limited to lawn maintenance, garden design, hardscaping, irrigation, and seasonal cleanups ("Services"). All Services are performed at the property address specified in your service agreement or quote.

2. Quotes and Pricing

  • Written quotes are valid for 30 days from issuance.

  • Prices exclude applicable Texas sales tax unless stated otherwise.

  • We reserve the right to adjust quotes if site conditions differ materially from the initial assessment (e.g., hidden underground utilities, rock, or contaminated soil).

  • Additional work requested after project commencement will be billed at our standard hourly rate of $[XX]/hour plus materials.

3. Scheduling and Access

  • Scheduled service dates are weather-dependent and may be rescheduled with 24-hour notice.

  • You must provide clear access to all work areas and disclose any underground utilities, sprinklers, or pet waste.

  • We are not responsible for damage to unmarked utilities or items left in work areas.

4. Payment Terms

  • A 50% deposit is required for projects over $1,000.

  • Remaining balance is due upon completion unless alternative terms are agreed in writing.

  • Payments accepted: cash, check, credit card (+3% fee), or ACH transfer.

  • Past-due invoices accrue interest at 1.5% per month.

  • We may file a mechanic’s lien on the property in accordance with Texas Property Code Chapter 53 for unpaid balances exceeding 30 days.

5. Cancellations and Refunds

  • Deposits are non-refundable for cancellations within 48 hours of scheduled start.

  • No refunds for completed work.

  • Weather-related delays do not entitle you to refunds.

6. Warranties and Guarantees

  • Plants: 1-year warranty on properly maintained trees/shrubs; 90 days on annuals/perennials. Warranty void if customer fails to water or maintain as instructed.

  • Hardscaping: 2-year warranty on materials and labor against defects (excludes damage from vehicles, settling, or acts of God).

  • No warranty on existing customer-provided materials.

  • ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW.

7. Customer Responsibilities

  • Maintain adequate irrigation after installation.

  • Prevent vehicle traffic on new sod/seed for recommended period.

  • Notify us within 7 days of any concerns with completed work.

8. Limitation of Liability

  • Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

  • We are not liable for consequential, incidental, or punitive damages, including plant loss due to customer neglect, extreme weather, or pre-existing conditions.

  • We carry general liability insurance of $1,000,000 and workers’ compensation as required by Texas law.

9. Force Majeure

We are not liable for delays or failure to perform due to events beyond our control, including severe weather, supply chain disruptions, or government regulations.

10. Intellectual Property

All project designs, photos, and content on this Website remain our property. You grant us permission to photograph completed work for marketing purposes.

11. SMS Communications

By providing your mobile phone number and opting in via web form, keyword, or other method, you consent to receive SMS messages from Wacoscapes, LLC. Messages may include appointment reminders, scheduling updates, project quotes, service alerts, payment reminders, and promotional offers.

You may receive up to 4 messages per month. Frequency may vary. Message and data rates may apply.

Carriers are not liable for delayed or undelivered messages. We do not share your phone number with third parties for marketing purposes without consent. Compatible carriers include major U.S. networks (AT&T, Verizon, T-Mobile, Sprint, etc.).

12. Termination

We may terminate services immediately for non-payment, unsafe site conditions, or abusive behavior toward our staff.

13. Dispute Resolution

  • Governing Law: Texas

  • Any disputes shall first attempt resolution through good-faith negotiation.

  • If unresolved after 30 days, disputes under $10,000 shall be resolved in McLennan County Justice Court; larger disputes through binding arbitration under AAA rules in Waco, Texas.

14. Changes to Terms

We may update these Terms at any time. Continued use of our Services after changes constitutes acceptance of the new Terms.
